Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and GuestQuest(“GuestQuest,” “we,” “us,” or “our”). They govern your access to and use of the GuestQuest website, mobile-web experiences, APIs, printed kits, and any related services (collectively, the “Service”).
By scanning a GuestQuest QR code, tapping “Let's Go!,” logging into the admin dashboard, signing in as an Event Co, uploading a photo, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. Who May Use the Service
1.1 Age Requirements
The Service is designed for use by people of many ages — including kids at family events, weddings, birthday parties, and youth sports. However:
- Under 13: If you are under the age of 13, you must have a parent or legal guardian's permission before creating a guest session, uploading a photo, having your photo uploaded, or using any other feature. We rely on the event host and your parent/guardian to supervise your participation. A parent or guardian who allows a child under 13 to use the Service is consenting on the child's behalf to these Terms and to our collection and use of the child's data as described in our Privacy Policy.
- 13–17: If you are 13–17, you may use the Service with your parent or guardian's permission. By using the Service, you represent that such permission has been given.
- 18+: By using the Service, you represent that you are at least 13 years old (or have parental consent) and that you have the legal capacity to accept these Terms.
1.2 Admins, Hosts, and Event Coordinators
If you are setting up an event, operating the admin dashboard, or logging in as an Event Coordinator, you additionally represent that you have authority to bind the organization hosting the event and to grant the rights described in Section 4.
2. Guest Sessions and Accounts
Most guests use the Service without creating a traditional account — you simply enter a display name (and optionally an email) to start a session. If you provide an email, we may email you a magic link so your points, badges, and prizes follow you across devices. You are responsible for keeping your magic link confidential. You may remove your session by emailing hello@guestquest.app or by using any account-deletion mechanism we provide in-app.
Admin accounts require a username and password and are subject to the additional account-security obligations described in Section 9.
3. Acceptable Use
You agree not to use the Service to:
- Upload, share, or distribute any content that is illegal, obscene, sexually explicit, violent, hateful, harassing, defamatory, or invasive of another's privacy.
- Upload photos or videos of minors without the consent of the minor's parent or legal guardian, or in any setting where photography is prohibited (e.g., certain locker rooms, bathrooms, or private medical settings).
- Upload content that infringes the intellectual-property rights, publicity rights, or privacy rights of any third party.
- Impersonate another person, misrepresent your affiliation with a person or organization, or attempt to scan for, harvest, or sell other guests' data.
- Bypass or attempt to bypass any security or access-control measure, tamper with prize or points logic, or interfere with the integrity of the Service or any host's event.
- Use the Service to stalk, harass, or harm any person, including other guests, staff, or children at an event.
We reserve the right, but have no obligation, to remove any content or account that we determine in our sole discretion violates these Terms or is otherwise harmful. Event hosts and Event Coordinators also review, approve, and may reject content from their events — see Section 4.3.
4. Your Content and Licensing
4.1 You Own Your Content
Photos, videos, captions, messages, and any other content you submit (“Your Content”) remain yours. We do not claim ownership of Your Content.
4.2 License You Grant to GuestQuest
To operate the Service, you grant GuestQuest a worldwide, non-exclusive, royalty-free, sub-licensable license to host, store, cache, display, reproduce, modify (e.g., resize, crop, compress), create derivative works from (e.g., applying filters you select), and distribute Your Content, solely as necessary to provide the Service to you and the event host — including showing the content in the event gallery, leaderboard, TV display, recap emails, and any other in-product surface.
4.3 License You Grant to the Event Host
When you submit content to an event, you also grant the event host (the organization that set up the event) a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content for the purposes of the event and the host's post-event marketing, social media, internal communications, newsletters, sponsor recaps, and similar promotional use. This license is what lets a wedding family make a slideshow, a team board publish the end-of-season recap, or a venue re-share a highlight on Instagram.
If you do not wish to grant the host this license, do not upload the content. If you want content removed from a specific event after upload, contact the event host directly or email hello@guestquest.app and we will work with the host to honor your request.
4.4 Content of Other People
If your content includes other people — especially children — you represent that you have the necessary permission from those people (or their parents/guardians) to photograph them and upload the photo to the Service under these Terms.
4.5 Moderation and Removal
Event hosts and Event Coordinators may approve or reject content submitted to their events. GuestQuest may additionally remove content that violates these Terms, applicable law, or a lawful request from a rights-holder or court. Removal of your content is not a penalty and does not affect points, prizes already awarded, or session data beyond the removed item itself.
5. Photos of Children (Additional Protections)
Because GuestQuest is often used at family events and youth sports, we take extra care with content involving children:
- Event hosts are responsible for communicating their photo policy to attendees and for obtaining any permissions required by law or venue rules before running a GuestQuest event involving children.
- Parents and guardians control whether their child participates. A child's use of the Service is deemed authorized by their parent/guardian when the parent/guardian has consented or is present and supervising.
- We provide event hosts tools to moderate (approve, reject, delete) every photo before it appears publicly in the event gallery.
- Parents and guardians may request deletion of any photo of their child at any time by contacting the event host or emailing hello@guestquest.app. We will delete the content from our systems within a commercially reasonable time unless preservation is required by law.
- We do not knowingly use photos of children for our own marketing, model-training, or any purpose outside providing the Service to the host and the guest without explicit opt-in consent from the parent/guardian.
6. Prizes, Points, and Sponsors
Points, badges, treasure-box drops, slot-machine spins, and prizes are part of the gameplay designed by each event host. Prize fulfillment (drinks, merchandise, experiences, gift cards, etc.) is the responsibility of the event host or the named sponsor — not GuestQuest. Prizes may be subject to the host's rules, availability, and applicable law (including alcohol, contest, and sweepstakes regulations).
Some sponsor integrations may share your display name and high-level event stats (not your email or other contact info) with sponsors when you redeem a sponsor-funded prize. Sponsor data sharing is described further in our Privacy Policy.
7. AR, Face Filters, and Biometric-Related Features
GuestQuest includes optional features that process imagery on your device in real time:
- Face Filters: when you choose a face filter, your camera feed is processed locally in your browser using MediaPipe Face Mesh. Landmark points are used only to anchor a graphic overlay. No face-mesh data is sent to our servers or stored.
- AR Hunt: when you use the AR hunt, MindAR and your device camera detect a printed marker locally. Only the identity of the matched marker and your points update are sent to our servers, not the video feed.
- Find My Photos: if an event has this feature enabled, you may opt in by submitting a selfie to find photos of yourself across the event gallery. This uses face-recognition embeddings. See our Privacy Policy for details on storage, retention, and deletion, and the special consent considerations for minors.
8. Intellectual Property
GuestQuest, the GuestQuest mascots, our logos, the GuestQuest name, and the look-and-feel of the Service are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service except as expressly permitted in writing by us.
9. Admin Account Security
If you have an admin account or Event Coordinator PIN, you are responsible for keeping your credentials confidential, for all activity that occurs under your account or PIN, and for promptly notifying us of any unauthorized access. We may suspend or terminate admin accounts that do not comply with these Terms.
10. Third-Party Services
The Service integrates with third-party services (including but not limited to Supabase for data hosting, Resend for email delivery, MediaPipe and MindAR for on-device computer vision, and the Instagram, Facebook, TikTok, and WhatsApp platforms for social sharing). We are not responsible for the terms or privacy practices of third-party services. Their terms and policies apply to your use of them.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT PRIZES WILL BE AVAILABLE, OR THAT PHOTOS WILL BE RETAINED INDEFINITELY.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GUESTQUEST AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID GUESTQUEST IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $100.
13. Indemnification
You agree to indemnify and hold harmless GuestQuest and its officers, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your content, or your use of the Service.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 4, 8, 11, 12, 13, and 15) survive.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising under or related to these Terms will be resolved exclusively in the state or federal courts located in the County of Los Angeles, California, and you and GuestQuest consent to personal jurisdiction and venue there. If any provision of these Terms is held unenforceable, the remainder will continue in full force.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top and, for material changes, notify admin account holders by email and show an in-product notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
